Are all gun crimes federal offenses?
Answer: No. The ones that I’ve done that were federal offenses usually are involving guns that are brought from different states, that have crossed state lines. Generally speaking, most of the gun crimes that are just specific gun crimes—that are absent murder or assault with a deadly weapon—are basically crimes involving people who possess guns that are convicted felons. Those are all usually state crimes because they involve just state convictions or a felony conviction, and therefore if you do possess guns in most states, you would have a criminal consequence to that if you are a convicted felon, because as a convicted felon you are not allowed to possess guns; you give up that right under our Constitution. The other types of gun crimes that involve violence, those are generally prosecuted in the state court.
